Terms and Conditions
  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Submissions are only open to Australian residents.
  3. Participants under 18 years old must have parental/guardian approval to submit a nomination and further, the parent/guardian of the participant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  4. Employees (and their immediate families) of the Promoter, Coles and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Submissions into the promotion open on 01/04/24 and close at 11:59pm AEDT on 07/05/24 ("Promotional Period").
  6. Prior to submission of a nomination by participants, each local sporting club must visit www.FNTSportsPromo.com.au and follow the prompts to register the club to be eligible to receive tokens as part of this promotion.
  7. To be eligible to enter, participants must purchase any Four’N Twenty product (each an "Eligible Product") from any Coles retailer during the Promotional Period and retain their purchase receipt.
  8. To submit a nomination on behalf of their local sporting club, participants must then complete the following steps during the Promotional Period:
    1. Visit www.FNTSportsPromo.com.au and follow the prompts to the promotion page;
    2. Select their registered local sporting club from the drop-down list;
    3. Input the requested details;
    4. Specify the number of Eligible Products purchased;
    5. Upload a copy of their purchase receipt; and
    6. Submit the fully completed submission form.
    Each submission submitted by a participant will result in the nominated local sporting club receiving one ‘token’ to add to their tally.
  9. Multiple submissions permitted, subject to the following: (a) only one (1) submission permitted per Eligible Product.
  10. Participants must retain a copy of their purchase receipt(s) for all submissions as proof of purchase. Failure to produce the proof of purchase for all submission when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a participant’s submissions. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to the time of submission.
  11. The Promoter reserves the right, at any time, to verify the validity of submissions and participants (including a participant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any participant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the submission process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  12. Incomplete or indecipherable submissions will be deemed invalid.
  13. If there is a dispute as to the identity of a participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant.
  14. This is a game of skill and chance plays no part in determining the winner. Prizes will be awarded based on the number of tokens received.
  15. At the end of the Promotional Period, local sporting clubs will be separated into four (4) ‘Tiers’ based on the number of club members. The top number of local sporting clubs in each Tier (as noted in the table below) that have accumulated the most tokens will receive the prize detailed below:

    Each winning local sporting club will receive:
    1. AU$1,000.00 to be deposited into the local sporting club’s nominated Australian bank account; and
    2. 11 cartons (240 x 175g) Four’N Twenty Classic Meat Pies valued at $1,056.
  16. In the event of a tie for tokens accumulated between two (2) or more local sporting clubs in a single Tier, the Promoter will determine the winner as follows: each local sporting club will be required to submit a response in 100 words or less to the promotional question, "Why does your club deserve the prize?".
  17. Winning local sporting clubs will be notified by email and phone.
  18. The Promoter’s decision is final and no correspondence will be entered into.
  19. If for any reason a winning local sporting club does not take the prize at/by the time stipulated by the Promoter, then the prize will be forfeited.
  20. Total prize pool value is AU$102,800.
  21. Prizes, or any unused portion of a prize, are not transferable or exchangeable.
  22. As a condition of accepting a prize, a representative of a local sports club must consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any participant or local sporting club; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  24. Any cost associated with accessing the promotional website is the participant’s responsibility and is dependent on the Internet service provider used.
  25. The use of any automated submission software or any other mechanical or electronic means that allows a participant to automatically submit submissions repeatedly is prohibited and will render all submissions submitted by that participant invalid.
  26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any submission or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or participant; or (f) use of / taking of the prize.
  28. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Submission is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at pattiesfoods.com.au/Privacy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participant. The Privacy Policy also contains information about how participants may opt out, access, update or correct their PI, how participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All submissions become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion participants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
